Bailiff enforcement cost calculator

In a monetary-claim enforcement, the bailiff collects from the debtor a proportional fee of 10% of the amount enforced (art. 27(1) of the Bailiff Costs Act). If the debtor pays into the bailiff's hands within one month of the notice of enforcement, the fee is only 3% (art. 27(2)). The fee cannot be lower than 150-300 zł or higher than 50 000 zł.

As a rule the enforcement fee is borne by the debtor - the bailiff collects it directly from them (art. 27(1)). The creditor bears the fee only in special situations, for example when they themselves apply to discontinue the proceedings (art. 29(1) - 5% of the amount still to be enforced) or when starting the enforcement was clearly unjustified (art. 30).

Yes. The simplest way is a voluntary payment into the bailiff's hands within one month of receiving the notice of enforcement - the fee then drops from 10% to 3% (art. 27(2)). In addition, the debtor may apply to reduce the enforcement fee where special circumstances justify it, relating to the bailiff's workload or the debtor's financial situation and income (art. 48); the application is filed within 7 days of service of the fee order.

Proportional fees in a single case cannot exceed 50 000 zł (art. 25(1) of the Bailiff Costs Act). The lower limits depend on how the enforcement ends and range from 150 zł (payment within one month) to 300 zł (enforcement by means other than a bank account or wages).
