Frequently asked questions about the Polish court fee
How much is the fee on a claim for payment?
Up to a claim value of 20 000 PLN the fee is fixed and ranges from 30 to 1000 PLN across seven brackets (art. 13 ust. 1 of the Act on court costs in civil cases). Above 20 000 PLN a proportional fee of 5% of the claim value is charged, capped at 100 000 PLN (art. 13 ust. 2). The remainder is rounded up to a whole zloty (art. 21).
What is the fee on an appeal, and on an interlocutory appeal?
An appeal and a cassation complaint carry the whole fee, exactly as a statement of claim does (art. 18 ust. 2). An interlocutory appeal carries one fifth of the fee (art. 19 ust. 3 pkt 2) and an objection to a default judgment one half (art. 19 ust. 1). None of these fees may be lower than 30 PLN (art. 20 ust. 1).
Does mediation reduce the fee on a claim?
Yes. If before bringing the action the claimant took part in mediation under a mediation agreement, or applied for out-of-court resolution of a consumer dispute, the fee on the claim is reduced by two thirds, but by no more than 400 PLN (art. 13e).
What does a consumer pay for objections to an order for payment?
Objections to an order for payment issued in the order-for-payment procedure carry three quarters of the fee, but where the order was issued against a consumer the consumer defendant pays no more than 750 PLN (art. 19 ust. 4).
