Frequently asked questions about computing deadlines
Does the day of service count towards the term?
No. Where a term in days starts with an event, the day on which the event occurred is not counted (art. 111 § 2 of the Civil Code). A seven-day term running from service on a Monday therefore ends on the following Monday.
When does a one-month term running from 31 January end?
A term in months ends with the day whose date corresponds to the first day of the term, and if there is no such day in the last month, on the last day of that month (art. 112 of the Civil Code). A one-month term from 31 January therefore ends on 28 February, or 29 February in a leap year.
What happens when a term ends on a Saturday or a holiday?
If the end of a term for performing an act falls on a statutory non-working day or on a Saturday, the term expires on the following day that is neither (art. 115 of the Civil Code). The list of statutory non-working days is in art. 1 of the Act of 18 January 1951, and it covers Sundays and 24 December as well.
Does posting a letter on the last day preserve the term?
For a procedural term, yes. Handing the pleading in at a Polish universal-service postal operator, or at such an operator in another EU member state, counts as filing it with the court (art. 165 § 2 CCP). A substantive term normally turns on when the declaration reaches the addressee.
